Terms of Service

1. Scope

These Terms apply to all dealings between us and you in relation to the Service. Notices and guidance we publish in the App or on this site form part of these Terms.

2. Your account

1. Using the Service requires an account. Please register accurate details.
2. You are responsible for your account. Do not share your sign-in credentials with anyone.
3. Actions taken through your account are treated as taken by you.
4. You may not use the Service if you are under 13.

3. Family groups and invites

1. The Service shares photos and records within a "family group".
2. Anyone holding a valid invite link can join. You are responsible for who you send invite links to. Links expire seven days after they are issued.
3. Members of a family group can view and add to that group's photos and records, including content posted by other members.

4. Your content

1. You retain all rights to the photos, notes, and other records you upload ("Your Content"). We acquire no ownership of it.
2. We process Your Content only as needed to operate the Service: storing it, displaying it, generating thumbnails, delivering it to members of your family group, and backing it up. We do not use it for advertising, promotion, or as training data for machine learning.
3. You represent that you hold the necessary rights to the content you upload and that it does not infringe the rights of others.

5. Prohibited conduct

You may not:

• break the law or public order
• infringe anyone's copyright, likeness rights, privacy, or other rights
• upload photos of other people without their consent
• interfere with the operation of the Service, attempt unauthorised access, or reverse engineer it
• use automated means to access it at scale or scrape data
• use the Service in a way or at a scale we did not intend

6. Fees and storage limits

1. The Service is currently provided free of charge.
2. Free use is subject to limits on storage and photo count. When you reach a limit you can no longer upload new photos, but viewing, exporting, and deleting your existing photos continue to work.
3. We may later offer a paid plan with higher limits. If we do, we will tell you the price and terms in advance.

7. Changes, interruption, and discontinuation

1. We may change, add to, or remove features of the Service without prior notice.
2. The Service may be temporarily unavailable for maintenance, faults, or other unavoidable reasons.
3. If we discontinue the Service entirely, we will give you at least 30 days' notice in the App or by email, and keep the export feature working throughout that period.

8. Suspension and account deletion

1. You can close your account at any time from the App's settings. What happens to your data afterwards is described in Section 6 of the Privacy Policy.
2. If you breach these Terms, we may suspend or delete your account without prior notice.

9. Disclaimers

1. The Service is provided "as is". We do not warrant that it will meet your particular needs, be continuously available, or be free of defects.
2. We take care to protect your data, but we cannot guarantee against loss or corruption. Please keep your own copy of photos that matter to you using the export feature.
3. We are not responsible for disputes between users, or between a user and a third party.

10. Limitation of liability

Except in cases of our wilful misconduct or gross negligence, our liability to you is limited to ordinary, direct damages actually incurred, capped at the amount you paid us in the preceding 12 months (for free use, we disclaim liability to the fullest extent permitted by law). Nothing in this section limits liability that cannot be limited under mandatory law, including consumer protection law.

11. Changes to these Terms

We may revise these Terms. We will announce significant changes in advance in the App or on this page. Continuing to use the Service after a change means you accept the revised Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of Japan. Any dispute relating to the Service will be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance. If you are a consumer resident in a country whose law grants you the right to bring proceedings in your local courts, this section does not remove that right.
